By all accounts, this was an avoidable tragedy. As FOX 2 Detroit reports, the 19-yr-outdated employee did not have a driver’s license and did not know how to travel a handbook-transmission auto. When the worker acquired in the Jeep to start the engine, he took his foot off the clutch pedal and the Jeep began transferring, placing and killing Hawkins.

“He was an outstanding male,” David Femminineo, an attorney for Hawkins’ family members, explained to FOX 2. “The two-calendar year-previous, who was about a single at the time of the incident, the time of the death—he’ll never ever know his father.”

As Femminineo defined to Jalopnik, the Hawkins loved ones cannot instantly sue the dealership or its administration. Michigan workers’ payment legislation states you can not sue a fellow worker for negligence whilst on the work. So the Hawkins family’s only solution was to sue the Jeep operator. But that does not suggest the Jeep owner will be held liable for the accidental loss of life.

In accordance to Femminineo, when the Hawkins relatives filed go well with versus the Jeep owner, that person immediately sued the dealership for indemnification, and gained. With that victory in place, no matter what success from the Hawkins family’s accommodate from the Jeep proprietor will be the authorized responsibility of Rochester Hills Chrysler Jeep Dodge (and their coverage company). Essentially, even though the owner of the Jeep is named in the match, that man or woman won’t face any repercussions from the demo or judgment.

In accordance to Femminineo, the demo is established for Could 20 in Oakland County, Michigan. The loved ones is in search of $15 million in damages.

Why did Rochester Hills Chrysler Dodge Jeep employ a 19-year-aged with no driver’s license, or let that staff assist with services-department do the job that clearly needed driving skills that person lacked?
